For over two (2) years, we've been following the Local Union Election(s) debacle at UFCW Local 5, including the DOL ordered 3rd Union Election Here, including the official announcement on December 1, 2014, that there is a New Regime in Power at Local 5!

We can now follow UFCW Local 5's President John Nunes, Secretary Treasurer Jack Landes, including the "new" Executive Board as they proceed into the future as the "New Regime in Charge at UFCW Local 5!

President John Nunes, Secretary-Treasurer Jack Landes and thirty executive board members from throughout Local 5’s jurisdiction were sworn in today.

The swearing in brings to a close a long chapter in Local 5’s history and marks a new start for the union. The swearing in was performed by Tina Maier and Dan MacDonald, Local 5 retirees and long time staff members from the Hayward office.

Congratulations to all officers and e-board members and good luck in your new terms.

Depending how badly Nunes wants the UFCW I.U. V.P. title, don't think for a moment that the UFCW I.U. hasn't already informed Nunes about the "ground rules" / "proper behavior" in order to maintain the UFCW I.U. V.P. position within UFCW Local 5!

Oh.. I almost forgot about the financial perk for being a UFCW I.U. V.P.

F.A.I.R. "Sold Roger Out" when "former" Local 5 President Ron Lind, unjustly fired Roger during the first Local 5 Union Election.

F.A.I.R. subsequently refused to support Roger and denied his termination grievance!

It is my understanding that during the DOL ordered 3rd Local 5 Nomination / Election, the DOL had ruled that Pete Derenale was NOT eligible to run for Vice President No.1 due to the fact that he was not employed in Napa or Solano Counties!

It was also my understanding that following the big controversy following the sale of Local 5's former Union office in Vallejo....

President Lind, in his own words, states the following.

"The cost on Local 5 of this increase between now and the end of our Agreement will be more than $750,000 and quite possibly, as much as $1 million.”

Depending on which one of the above figures you decide to use, Local 5, after receiving $488,639.00 for the sale of the “former” Local 373 office, the “possibility” still remains, that we “may” still have a discrepancy?

So here is the unanswered question:

President Lind, based on your “Integrity and Financial Accountability”, please provide us with the “rest of the story”!
...and with Local 5's Vallejo office being closed, Pete Derenale and other's have been working out of UFCW Local 5's office in Martinez / Contra Costa County.

As far as I know this all may be legit?

However, "if" the DOL ruled that Derenale wasn't eligible to run for V.P. No. 1 at the time during the 3rd election, then how does Derenale now be allowed to secure the V.P. No. 1 position after the election?

The reality of a Compliance Audit by the Department of Labor at UFCW 770, going on at the same time of nominations/ elections would be disastrous for Team Icaza. Especially when their providing all the documentation needed.

Now that we have a New Regime in Power at Local 5 I'm intrigued about the thought of a Compliance Audit by the Department of Labor be requested / initiated here at UFCW Local 5!

Based on your expertise, please provide me with some information as to how this can be accomplished. Can any individual (active / retiree) initiate said process with the DOL here at Local 5?

As a current Retiree, I believe that it is very important for each and every Active Member / Retiree who is a participant in the UFCW-Northern California Employers Joint Pension Trust Fund to immediately start demanding answers from our Union Leadership as to the current status / funding of our Food Pension Plan!

For the past several years, as our Union Leaders enter into Food Negotiations, ratify a Contract, while boasting of their "alleged" Contract successes, which include Pension, H&W etc., many unanswered questions remain concerning our Pension Plan.

As outlined in the Notice of Critical Status For The UFCW-Northern Ca. employers Joint Pension Trust Fund, we were informed that on March 31, 2014, the Plan's actuaries certified to the U.S. Department of the Treasury, and to the Trustees, that the Plan is in critical status ("Red Zone") for the Plan Year beginning January 1, 2014.

Under the Rehabilitation Plan, we were also notified that "this is the fifth year the plan has been in critical status."

I do not understand how this continues to happen?

I would suggest that our Active Members start demanding answers from their Union Leaders, as to when we can expect our Pension Plan not to be in critical status and no longer in the ("Red Zone")!

Ask your Union Leaders what needs to happen to accomplish this very important task.

Five (5) years in critical status is long enough!

Status of the Contract and the Save Mart-Lucky Labor Board Charges:

Local 5’s position is that the terms of the expired agreement remain in effect. This also means the Stabilization Agreement expired and is no longer applicable. Save Mart agrees that the Stabilization Agreement expired and does not apply. Save Mart takes the position that it could lawfully implement its LBF. Local 5’s position is that the company could not implement its LBF since the negotiation process was still continuing. That issue will be resolved by the unfair labor practice charges filed by the union against the company.

The government entity that oversees unfair labor practices, National Labor Relations Board (NLRB), is continuing their investigation into the unfair labor practice charge filed against Save Mart-Lucky regarding the company’s unlawful implementation of their LBF proposals. While we are confident the board will issue a complaint against Lucky/Save Mart, the company will probably litigate it and, thereafter, appeal it to the 5 member Labor Board in Washington D. C. This process will take a year or more.

If Local 5 prevails the NLRB will require the rescission of the negative items of the unlawful implementation and retain the proposals that are favorable. Back pay will be paid to our members.
