As we approach December 1, 2016, two (2) years since Team Nunes, a.k.a. UFCW Local 5's Triple Clown Act, were "officially" sworn into office on December 1, 2014, it's hard to believe that Local 5's next cycle for their Election of Officer's is just around the corner in July 2017.



For the record, let's recap some of the highlights leading up to that December 1, 2014 event.

First: E-Mail dated November 17, 2014 re: Oath of office taking place via phone conference.

President John Nunes, Secretary-Treasurer Jack Landes and thirty executive board members from throughout Local 5’s jurisdiction were sworn in today.

The swearing in brings to a close a long chapter in Local 5’s history and marks a new start for the union. The swearing in was performed by Tina Maier and Dan MacDonald, Local 5 retirees and long time staff members from the Hayward office.

Congratulations to all officers and e-board members and good luck in your new terms.

Fourth: For those of you who may not be aware of it, as a result of the DOL 3rd Ordered Local Union Election, Local 5 now has a brand new term of office for their Officers.

Speaking of the new term of office at UFCW Local 5, I have some questions re: the accuracy of the UFCW Local 5 Bylaws as they pertain to this subject matter based on Local 5's posting on the DOL LM2 website.

Note: If Local 5 has updated and current Bylaws, one would expect Local 5 to publish them within their LM2 posting.

@ Team Nunes,.. do you have a current and updated version of Local 5 Bylaws newer than 2007? If so, please provide them to Local 5's membership. If not, please immediately provide Local 5 Members the opportunity to vote on a new set of Bylaws.

Until such time as to Local 5 providing updated Bylaws, I will continue to refer to the above mentioned Bylaws as outdated!

Now that I've laid out some of the groundwork re: this subject, let's proceed with the following here at Local 5,.....



On another post I will discuss my thoughts as to the various individuals who may attempt to run for Local 5 President and Secretary Treasurer.

The bigger question is, will President John Nunes have the courage to run for another term and "if" so, who will be his running mate?

Our last I.U. Convention was held in 2013.

The prior I.U. Convention would have been held in 2008.

The prior I.U. convention would have been held in 2003.

Having said that, why is UFCW Local 5 using outdated material in their LM2 Reporting postings?

Once again if I may I would like to address another issue I have found with respect to the previously mentioned 2007 outdated UFCW Local 5 Bylaws. (Signed & Approved by "former" UFCW I.U. President Joseph Hansen dated August 2, 2007)

Specifically, re: UFCW Local 5, it is important to note that the Merger of the "original" seven (7) Bay Area UFCW Local Unions, (#120,#373,#428,#839,#870#1096 and #1179) which created UFCW Local 5, became effective on January 1, 2007.

Subsequently, "former" UFCW Local 101 merged with UFCW Local 5 effective on or about, January 1, 2011.

Regarding "former" UFCW Local 101:

More importantly does Team Nunes, a.k.a. UFCW Local 5's Triple Clown Act, including UFCW Local 5's Executive Board, have any clue about their responsibility to maintain current and updated Bylaws?

Another fact that I would like to point out as it pertains to UFCW Local 5's Two (2) set of Bylaws, (8-2-07 & 9-30-11) is that following the 2011 set of Bylaws, the Department of Labor (DOL) was all over Local 5's shit investigating the conduct of their recent Local Union Election. (see below)

Ultimately said DOL investigation resulted in Local 5 being ordered to conduct a 3rd Election of Officers at Local 5 by the Department of Labor!

For now, here are some questions Local 5 members should be asking their Leadership, including Local 5's entire Executive Board!

1. What set of Bylaws (2007 or 2011) was the DOL, Local 5, including the I.U. using for their respective investigations during this time?

2. Why did Local 5 use the 2007 set of Bylaws for their LM2 document posting instead of using the signed and approved 2011 set of Bylaws?

3. Is there a updated signed and approved version of Local 5 Bylaws, which includes the recently changed New Term of Office, commencing December 1, 2014 and ending December 31, 2017 and or any other DOL ordered changes pursuant to their above mentioned investigation?

4. If so, did the Local 5 membership have an opportunity to vote on said Bylaws?

5. If so, when did that vote take place and what were the results?

6. If not, why not?

7. What set / version of Local 5 Bylaws will be used on their upcoming Election Of Officers in 7/2017?

8. How do Local 5 Members request / receive a current and updated version of Local 5 Bylaws?

9. Will Local 5 post on their website Local 5's most current signed and approved version of their Bylaws?

10. Will Local 5 provide their respective membership a written detailed explanation as to the facts surrounding the Two (2) Sets of Bylaws currently in question?

While we all wait and see which set of Bylaws Local 5 / I.U. want to play by, let’s take a look at Local 5’s potential cast of characters for their upcoming Election of Officers in 2017!

Well here we are, Thursday, January 12, 2017, getting closer and closer to another Local Union Election here at UFCW Local 5. I’m really curious if President Nunes will sign up for another 3 years and or if he does, will he actually have the courage to finish out the entire “new” 3 year term, assuming of course, if he could / would be re-elected by Local 5’s membership?

The next big question which remains unanswered as we approach the 2017 election, is whether or not, Nunes and Landes will continue to be on the same ticket?

Let’s assume for a moment the following.

President John Nunes and Secretary Treasurer Jack Landes decide to go in different directions.... with different individuals..... for the President and Secretary Treasurer positions respectively. Not to mention the “possibility” that “other” Local 5 paid staff, including any other dues paying members who may also want to pursue the top jobs at Local 5.

Who would be some viable candidates?

Here are some “possibilities” to review / monitor, using the previously mentioned Staff Directory from above.

Lets start at UFCW Local 5’s HQ.

JB not sure any of this really matters. Any within the UFCW these days that would run for office is already trained on how to be the corporate bitch. UFCW is a dead labor organization, the proof of that is they have been completely MIA in all the organizing and protesting going on against tRUMP.

I have been to many tRUMP protest in the past few months and the only presence of labor I've seen is from the Nurses union. There has been mass grassroots organizing going on all over this country and no presence of organized labor at all. That leaves the question....does big labor support tRUMP?

I'm involved with a grassroots progressive group and we our growing faster then we can keep up with! Just last night we massed 200 people to a city council meeting and got our city council to back track on a racist resolution they were trying to pass. What I'm trying to say here is doesn't really matter what corporate ass sucker is running these UFCW locals their all the same - in it for the money and could care less about the rank n file workers. That's ok though many of these rank n file workers are out organizing in progressive groups and have no need or time for labor fakers to get in the way and fuck things up. Millions of people organized and made history with one of the biggest protest in US history...the Women's March! No sign of the UFCW that day. Now the organizers of the Women's march are organizing a women's "General Strike" for March 8th. If it turns out anything close to what the women's march was it will cripple this country for a day! UFCW hasn't done anything like that in the 37 years I've been a member. JB at this point whatever "white male" who leads a UFCW local is irrelevant. People are doing things on their own and making history and once they turn those organizing skills and people power on to their greedy employers whatever corporate ass kissing chump running a UFCW local will be of no significance. In all this tRUMP insanity many good movements are happening and as usual the UFCW will stand on the sidelines that's just historical fact.
