18 thousand per for pilfering millions, I'm sure ccwipp plan members will feel vindicated - NOT!

FSCO and crown council should be hung by their incompetent ringlets.

According to this Benefits Canada article...

Quote:
As part of the sentencing, Judge Brown announced that the nine defendants were prohibited from using the planís assets to pay their fines or legal costs.

If that is truly the case, and they are on the hook for their high-priced defense team (and hopefully a huge costs submission from the crown)... then clap, clap, clap to Judge Brown. Very Happy

Well that's going to be interesting. According to their 2008 financial statement the CCWIPP fund spent anywhere from $1 million to $2 million on their legal defence - in that one year alone. Will the convicts (damn, that feels good) return that money to the pension fund? I'd say the members should get some legal advice on this question. Those freaks can't be allowed to get away with this.

Well... bankruptcy is probably the easiest route.

http://sbinfocanada.about.com/od/insurancelegalissues/a/bankruptcyproc.htm

The closing paragraph of this little article says:

... As you can see, the bankruptcy process is quite straightforward. Once you are discharged from bankruptcy in Canada, your debts will be cleared, except for certain types of debts that are excluded, such as alimony payments, child support, student loans, court-imposed fines and debts arising from fraud. You will be ready to make a fresh financial start.

Let's hope that "costs" falls under court-imposed fines eh? I woudl like to know a "fresh financial start" is further away than that.

I have no doubt whatsoever that the cost of the trustees' fines will be picked up by their employers. The millions paid out in legal fees from the pension fund will just be ignored - no matter what the judge said. Short of the members' taking these slimebags to court to try to get it back, nothing will be done about it. And the members aren't going to sue anybody who has has a $1 billion dollar pension fund to finance their defence. What a crock. No wonder Canada is the Nigeria of the North. We should change the national anthem to reflect this. Evil or Very Mad

That is what it will take. Court imposed fines mean nothing, the law leaves the responsibility of collection to victims. One would think a judge would want to see their rulings through to the end. That would be as simple as also ordering closing reports from convicts.

Of course doing so would be out of pocket for the legal community but imagine how it would clear the court congestion we hear so much about.
