The CCWIPP spin is out before the news, so I don't know how serious the charges really are.

Oh the spin-doctoring before the storm! If the charges are so trivial why don't the CCWIPP boys tell us what exactly they are and who exactly has been charged? We'll find out soon enough and we'll make sure everybody else does.

Here's one for you Bill... the mondo head shop-steward gets a phone call a couple weeks back... out of the blue and about a year and a half too late. Forget the obvious 'fishing for info'. Forget the fact the call was not made from the office, cell or home phone. Forget the lack of mentioning or asking about me (I'm so offended! There wouldn't be a problem with the UFCW pension plans, would there? There wouldn't be a little concern among the fringe players in everything going on, would there? Looks like we are going to see more opportunities for UFCW leaders to do their Dick Nixon imitation..."I am not a crook." At least a couple of them should be able to get their jowels a shakin as well. Wonder if they wanna do the two fingered peace sign as well. 10 supermarket, union executives charged with pension mismanagement I wonder if the CBC is going to start taking more of an interest in this national story as it begins to snowball? As i read these two stories of "mismanagement" i was stunned when it dawned on me the irony of the charges. How odd, upper management folks being duped by union guys to invest in questionable properties. Seemed hard to believe.
Were these trustees from the management side of the table that naive? Were the labor guys so smart they just overwhelmed the HR folks with shady reports of due diligence? Did one of the unions trustees just pat them on their big behinds and give them a wink and a nod? Were there whispered pledges of "not to worry?" Stop and think about this: I hate to say it, but usually the folks on the management side of the table are smarter (at least educationally). They most assuredly should have a better handle on the legal aspects of their positions as trustees. And, most importantly, they have nothing to gain by turning over plan assets to a convicted pedophile ex-priest. So what gives? Why are these bastions of business suddenly being dragged down the sewer with the boys from the labor side of the table? Easy, it's called trade offs. Management, in way too many trust funds, allows the union to run them. Many management trustees i have seen hate the idea of one more job to do. They know they need to be on the fund, but they don't want it to become more work than the occassional trust fund meeting. Dishing it off to the union leader, who has a vested and personal interest in using it to make members happy is just fine. By giving the union leader that kind of control, the employer sees a quid pro quo...you scratch mine, i'll scratch yours. Nice. Nice other than the fact responsibility ultimately falls on all trustees shoulders. In this case, ignorance is neither bliss nor a good defense. As this unfolds, it will be interesting to see if management trustees circle the wagon or look to play "Lets Make A Deal." _________________ If we don't do it, who will? |

You've hit the nail right on its ugly pointy head BP. My take on the management trustees is that these trustees appointments were "perks" that came with their jobs. They got to go to some meetings, attend some lavish conferences in exotic locations and add "trustee of largest multi-employer pension plan in Canada" to their resumes. That's the way employer trustees tend to view these positions.
Why'd they let the union guys go nuts with the money even though they must have been smart enough to know that a shitload of laws were being broken? In my opinion, there was a quid pro quo involved in this: The union guys would make nice at the bargaining table and the management guys would reciprocate by looking the other way on the harebrained pension investments. Their pension contributions were buying a decade of concessions and Cliff and boys could what the f**k they pleased with the money once it went into the plan. The normally cautious management types believed that no one would ever find out what was going on and - if it weren't for a couple of people with inquiring minds and a very active Internet connection nobody ever would have. The pension fleecing would be going on to this day and, with the thousands of new members coming into the plan who will never become vested (because of the concessionary wages which are sure to drive staff turnover in the grocery stores) and increased employer contributions, it could have gone on for f**king years - maybe decades. These pigs never dreamed that what Cliff and his crew were up to would become public or that the public exposure would put the regulator (usually very trustee-friendly) in a position where it would actually have to enforce the law.
