Here we are, nearing 6 months before the UFCW 770 Officers Election cycle.

This thread was created to dedicate it to the upcoming officers election at UFCW 770. So far there are two individuals that will be running for President at UFCW 770. Rick Icaza is the incumbent President.

As you have probably read already in other threads, UFCW 770 members in the last few years have made UFCW 770 run delegate elections, filed complaints with the Department of Labor against Shaun Barclay and the International, and even filed the first UFCW International Officers Complaint also with the Department of Labor.


One of the complaints led to the UFCW International returning $100,000 that was illegally transferred out of local 1036 (now partially 770).

Now it's time for a UFCW 770 Officers Election


The Department of Labor warns union officers that 6 months prior to the election process, their actions should be watched carefully because their actions can be seen as potential election violations.

@ Enforcer....... We are currently pretty busy here in Northern California dealing with the DOL "ordered" 3rd Union Election at UFCW Local 5. I will get back to you following said Election.

I had an opportunity to speak with the Department of Labor regarding some matters after the complainant filed the complaint against Shaun Barclay and the UFCW International. We had the pleasure of meeting some great investigators at the Department of Labor. In total between all the UFCW 770 members, we met and talked with five (5) investigators in total.

As you can imagine, a lot of us UFCW 770 members used this opportunity to inquire with the Department of Labor about our rights in local union elections and procedures that must be followed by both sides…

As you will see, UFCW 770 hosted a party “in appreciation of your contributions during the 2011 Grocery Workers Contract Campaign”. The “evening of celebration” took place on January 12th 2012. Notice the difference of 2011 and 2012: specifically note that the LA Times wrote an article on September 19th 2011 stating that the unions and employers had come to an agreement.

UFCW 770 decided to have an appreciation party almost four (4) months later. After showing this to a Department of Labor Investigator, the investigator smiled and said “violation”. Why? This party was

1. Four months later but…

2. During Rick Icaza’s Officers Election Nomination Month.
Over the next weeks and months we will look at the past actions of Rick Icaza when hes nearing a union officers election. May I remind everyone that Rick Icaza is also a International Vice President of UFCW International. As we have seen, some UFCW International Vice Presidents seem to have run into problems and have made bad decisions…

Shaun was absolutely right. The retired international rep. Couldn't even work in the Local, in the Midwest, because all he did was get in trouble, make promises to members, that he couldn't deliver , blame everybody but himself. Shaun helped him out many times, more then I ever would!

This email was sent to Paul Edwards (Field Director of UFCW 770) during the UFCW 770 officers election nomination month in 2012. At that time of this email, UFCW 770 officials were aware of members in three counties collecting signatures to run against UFCW 770 President Rick Icaza and Slate in 2012. Notice the email was sent in January 2012, on a Sunday. Again, January 2012 was the month for nominations for the last UFCW 770 Officers Election.

John Grant , Secretary –Treasurer (770) wrote a directive to Paul Edwards for “official union business” citing representation issues, so Paul Edwards (770 Field Director) could approach the opposition on union time.

We shared this document with the Department of Labor OLMS Investigator, and the investigator stated this was a very serious violation and extremely illegal. The investigator was then given a copy of the email per the Departments request.

This letter from Rick Icaza to the membership of UFCW 770 giving the members an update about the new secretary treasurer , John Grant. Dated November 2011. This letter was sent to the membership one month before nominations. Here's the other problem....

About 16 months late, Rick Icaza! As we can all tell by the letter and the timing of the letter is that this was planned like this for the purposes of being sent out during the election season. This violation makes me laugh every time I think about it....and it made the DOL Investigator have a good laugh when we showed it to the investigator.

I'm just getting started... more to come.
