To that point, for those of us who've followed the entire UFCW Local 1036 Trusteeship by the UFCW I.U., including the subsequent merging (splitting) of Local 1036 into UFCW Local 8, including UFCW Local 770 several years back, was the Local 1036 - 770 Merger ever really "officially" consummated?

Specifically, when reviewing the following Merger Agreement, (Excerpts).......

UNITED FOOD AND COMMERCIAL WORKERS • LOCAL NOS. 1036 AND 770 AND UNITED FOOD AND COMMERCIAL WORKERS • LOCAL NOS. 1036 AND 8GS

(Excerpts):

In order to achieve greater efficiency, align resources, seize new opportunities, develop growth focused local unions, and enhance the best interests of the membership, the United Food and Commercial Workers Local No. 1036 (Local 1036) shall merge, in part, with United Food and Commercial Workers Local No. 770 (Local 770) and, in part, with United Food and Commercial Workers Local No. 8GS (Local 8GS) (hereinafter collectively also referred to as the “Merging Local Unions”), on the terms and conditions set forth below.

I. STATEMENT OF MERGERS

A. The Membership of Local 1036 within the counties of Mono, Inyo, and Kern, excluding employees of Kaiser Permanente and other health care employees except the Henrietta Weil facility and the Professional and Technical Offices, shall merge with Local 8GS effective July 1, 2009. The remainder of Local 1036’s membership (including employees of Kaiser Permanente and all other health care employees, except the Henrietta Weil facility and the Professional and Technical Offices, in Mono, Inyo and Kern Counties) shall merge with Local No. 770 effective July 1, 2009. The newly merged Local Unions shall be known as the United Food and Commercial Workers Union, Local No. 8GS and United Food and Commercial Workers Union, Local No. 770, respectively (hereinafter also referred to as the “Merged Local Unions”).

B. The Merged Local Unions shall be two distinct entities operating pursuant to and governed by the Constitution of the United Food and Commercial Workers International Union (the “International Constitution”), the provisions of this Merger Agreement, and the respective bylaws of the Merged Local Unions, attached, as applicable, as Appendix A.

II. OFFICERS

A. The Officers of the Merged Local Unions shall hold office in accordance with the following provisions and shall be:

4. Local 770 shall hold nominations and an election of officers during the period from January 1, 2012, through June 30, 2012, for a three-year term of office commencing on July 1, 2012. The officers to be elected shall be President, Secretary- Treasurer, Recorder, and Executive Board Vice Presidents.

In accordance with Article VII, A. of Local 8GS’ bylaws there shall be two additional Vice Presidents elected and nominated by the Local 8GS Executive Board within ninety days from the date of the merger, to be filled by active rank and file members within the geographical jurisdiction of the former Local 1036, employed within the counties of Mono, Inyo or Kern counties.

6. The officers of Local 8GS shall hold office from July 1, 2009, through December 31, 2011.

7. Local 8GS shall hold nominations and an election of officers during the period from July 1, 2011, through December 31, 2011, for a three-year term of office commencing on January 1, 2012. The officers to be elected shall be President, Secretary-Treasurer, Recorder, and Executive Board Vice Presidents.

The Merged Local Unions’ Executive Boards shall each prepare and present new bylaws to the membership no later than December 1, 2009.

XIV. APPROVAL

This Merger Agreement has been approved by the current Executive Board members of Local 8GS and Local 770 and shall be submitted to a vote of the respective memberships of Locals 8GS, 770 and 1036 no later than May 5, 2009.

Following approval by the membership, this Agreement shall be submitted to the International Executive Committee for its approval.

If this Agreement is not so approved, it shall be null and void and of no effect.

The "official" filing of the complaint was March 2nd 2016. The investigator assigned to the case is Jack De La Torre, Investigator from the DOL Los Angeles Office. Mr. De La Torre comes from the DOL - San Francisco office. The same office that investigated the UFCW 5 Roger Rivera case.

How are we doing on updating the following?

With today being Friday, May 20, 2016,..........



Before the May 23, 2016 Expiration Date!

It is my understanding that, Team DOL,........i.e., Pearl Moenahele, Ed Oquendo, & Jack De La Torre, et. al.,(L.A. DOL Office)...... have concluded their investigation and have handed over their findings to Team DOL in Washington D.C.

Got to wonder if the DOL will request another extension or render their final decision on Monday, May 23, 2016?

@ Team DOL (L.A. & D.C.),....

Once again,......

As a "ongoing reminder", we do expect multiple individuals within UFCW Local 770, including the UFCW I.U., will be needing to,..........




Including but not limited to, "ordering" a new election at UFCW Local 770 which must include President Icaza's opponent appearing on the ballot!
