Team Nunes, a.k.a. The Triple Clown Act,....... may not be able to settle the SaveMart / Lucky Contract Siege, including their FoodMaxx Contracts, here at Local 5 for the past several years, but they sure can knock out remodeling projects within their respective Union offices!

LOCAL 5 TO CONTINUE FIGHTING FOR MEMBERS AND AMERICA

Local 5 certainly has had our share of challenges in 2016. Contract negotiations at Save Mart/Lucky continue. Significant progress was made during the year and Local 5 remains cautiously optimistic that an agreement can be reached very early in 2017.

Members at Food Maxx voted overwhelming in August to reject the final offer made by the company that was riddled with concessions similar to those now contained in the Save Mart/Lucky imposed concessionary agreement.

Unfortunately, the International Union has not acted on the strike sanction request from Local 5 that has been pending since the rejection vote.

Consequently, Food Maxx continues to reject bargaining dates and refuses to improve any of the detrimental proposals that would seriously undermine our member’s economic well being for themselves and their families.

Local 5 continues to fight on these two fronts with Save Mart.

Safeway has stumbled along on getting their payroll software matter corrected, delaying long awaited retro-active wages owed for thousands of their employees.

According to Safeway, this matter impacted four Safeway divisions and they have been fixing this problem in an order where employees were awaiting their retroactive pay the longest.

Local 5 has been notified by Safeway that they will receive the data to review and inspect by early January and it is hoped that retroactive checks will be available soon thereafter.

Local 5 will also be seeking an interest assessment on the delayed wages that were owed to employees since February, pursuant to the union contract.

Over the course of the year many independent markets, food processors, Rite Aid and agricultural units negotiated and ratified contracts at Local 5.

Well.... Well......... finally after several years Team Nunes and Team Perrone have gotten off their collective asses and have
allegedly received a Final Offer from SaveMart / Luckys / FoodMaxx!

The remaining question is what will the final offer look like?

Has Team Nunes and Team Perrone, .........



................With this recent announcement for final offers on behalf of the above mentioned bargaining units within Local 5?

Local 5 SaveMart / Lucky Members must be diligent and demand answers from Team Nunes has to the details of the proposed new deal! Did Local 5 Savemart / Lucky Members receive the identical contract as did Local 8 and Local 648? If not, why not?

One has to wonder “if” President Nunes will have the courage to attend any & or all of the upcoming meetings mentioned, or will he take his normal approach and stay home and make his minions conduct the meetings in his place?

Keep an eye open at said meetings for I.U. staff to be there. Rumor has it that the I.U. wants to make sure that Local 5 will be following thru on the I.U.’s directive to recommend this contract proposal to the affected members!

It appears Save Mart is flip-flopping everywhere.

Local 5 and the International Union cannot comprehend what Save Mart is trying to say and what they really mean in these offers.

The Last, Best and Final proposals are vague, ambiguous and left up to the interpretation of the company.

Local 5 will not vote the members until Save Mart is clear in their proposals.

Keep strong, stay together and Local 5 members will prevail with an acceptable contract that our Lucky and Food Maxx members deserve!


Question: If President John Nunes, Local 5’s / Chief Negotiator, along with his “other” Local 5 team members, having just recently negotiated this “new" deal with SaveMart / Luckys / FoodMaxx, then why in the Hell does Team Nunes need the UFCW I.U. to interpret the deal on behalf of Local 5?

The Local 5 member prohibition to vote on an agreement from Save Mart’s Lucky Division has been lifted by UFCW International President Marc Perrone.

Accordingly, the recent Last, Best and Final offer from Save Mart’s Lucky Division can now be voted.

Since some of the offer was vague and appeared to undermine previous understandings, it was necessary to request clarifications from the company, which Local 5 has now received.

Local 5 must conduct a mail referendum in accordance with the International Executive Committee’s directive under the International Constitution.

Local 5 will be sending out the offer, with a secret ballot to vote, on Tuesday January 24th.

Local 5 will conduct informational meetings in all geographical areas of Local 5 the week of Monday January 30th through Friday February 3rd. The dates, locations and times will be posted by this Tuesday January 24th.

Please check the website (www.ufcw5.org) and/or the Union bulletin board located in your store.

It is encouraged that all members attend the informational meetings to gain a full and complete understanding of the Last, Best and Final offer from the company.

The votes will be counted on Wednesday February 22nd at the Hayward Union office.


OK....so we finally know what Team Nunes and Team Perrone have decided on the next course of action for UFCW Local 5’s SaveMart / Lucky Members!

Local 5 recently received a Last, Best and Final offer from Food Maxx. The offer is little changed from the one overwhelmingly rejected by Food Maxx members last August.

Most importantly, Food Maxx is proposing that the employee health benefit plan be restructured to save the company money, but has provided few details of the new plan to the Union Bargaining Committee.

Food Maxx owes it to their employees and the Union to explain fully the details of the new health care benefit plan and what additional costs employees can expect, if any. Local 5 is awaiting a response from Food Maxx representatives.

Health care benefits and wages are the most important aspects of any job. Knowing what those health benefits include is critical to employees and their families. Your Union cannot explain what we don’t know. Once Local 5 receives details of the health plan from Food Maxx we will proceed with informational meetings and voting the company’s final offer.

Please continue to access the website for more information or talk to your Union Representative if you have further questions and, above all, remain strong and committed to a fair and equitable contract that Food Maxx members deserve!

Save Mart/Lucky Bargaining Update

February 6, 2017

The secret ballots for the Save Mart/Lucky Last, Best and Final offer will be counted on February 22, 2017 at approximately 3:00 PM at the Hayward office.

Accordingly, the Local 5 Executive Board has authorized a weekly strike benefit of $250 for Service Specialists and $300 for all other employees if Local 5 Save Mart/Lucky members authorize a strike by the UFCW International Constitution’s mandated majority of two-thirds (2/3rds) or more of the active membership.

Strike captains will be paid $400 per week. Strike preparations, or further bargaining, will be announced if a two-thirds (2/3rds) majority of the membership rejects the Last, Best and Final offer presented by the company.

The UFCW International Union has rescinded the Save Mart/Lucky membership voting ban commonly referred to as Article 23(A) of the International Constitution and will sanction a strike if the requisite majority of two-thirds (2/3rds) of the active membership is achieved.

The International Union usually approves an additional strike benefit of $100 per member per week. Strike benefits are paid at the end of the second week of strike duty.


It will be interesting to see the final outcome of the mail ballot count on February 22, 2017?!?!

With the UFCW I.U. “allegedly” rescinding Article 23,......and UFCW Local 5 “allegedly” preparing for a strike........
