Top Ten (10) Colossal Blunders Presidents Lind, Loveall & Sharpe, a.k.a. "The Sellout Alliance", negotiated into our 2011-2012 Contract Settlements with (SaveMart / Luckys), (Raleys / Nob Hill) & Safeway!

******************************************************
Number Eight: Serious questions / concerns remain as to WHO WILL REALLY BENEFIT from the language contained in the 2013 UEBT AGREEMENT!!!!!

Will our Active Member’s, including the Retiree’s and all their families, benefit from the following “additions” and “modifications” contained in the 2013 UEBT Agreement, or will said new language “only” benefit Lind, Loveall and Sharpe, including their “Employer Buddies”?
Quote:
Let us first examine a portion of the 2013 UEBT Agreement.

2013 UEBT Agreement
http://www.uncharted.ca/images/users/ssigurdur/2013_uebt_agreement.pdf

“The parties agree as part of these negotiations, the bargaining parties will direct the Trustees of the Northern California UFCW –Northern California employers Joint Pension trust fund and the UFCW Benefits Trust Fund to implement the following additions and modifications if they determine that they are legal, do not violate any fiduciary responsibility or duty of the Trustees and are prudent expenditure of Trust funds”:

Family Care and Wellness Centers:

Marketing and branding of the UEBT:
Quote:
I believe that Lind, Loveall and Sharpe's main objective in pursuing this new language was their pipe dream for a cash cow for the sole purpose of generating income for whom-ever????

Maybe this is where the "pay back" to Safeway comes back from the "Sell Out Alliance"?????

Specifically let's examine the following:

Family Care and Wellness Centers:

The parties agree to direct the UEBT to participate in the development of "Family Care and Wellness Centers" throughout the jurisdiction of the signatory unions.

Participation shall include making appropriate investments in the centers. These centers are intended to efficiently provide high quality primary health care services at minimal or no out-of-pocket cost to member participants.

These centers will contribute to stabilizing health care costs. The beta test center shall be established in Sacramento, California and any other area(s) approved bt the Trustees.
Quote:
Well right off the bat WE get our first "peak under the covers" as to which Local Union stands to benefit from the "first" "Beta Test Center"!!!!!

The beta test center shall be established in Sacramento, California and any other area(s) approved bt the Trustees.

Having said that, with UFCW Local 8 / President Jacques Loveall, having negotiated the "first" Center within his jurisdiction, now the puzzle pieces are coming together as to the "possibility" of a cash cow Plan developing here in Northern Ca.
I wanted to review the above before I share with you the following!

Check out the following website link and take the time to identify all the players.

Now click on UFCW Local 8 President, Jacques Loveall. http://www.americasagenda.org/Background/Our-Team/Jacques-Loveall.aspx

Specifically,......

Quote:
Loveall established The Health Education Advocacy and Responsibility Team (healthcareexchangeadvocates.org), a coalition of labor, business and healthcare providers focused on shaping the California Health Care Exchange.
It appears that there may be a location in Sacramento, Ca. that is open and or may be opened in the near future...

Just follow the $$$$$$$$$$$$$$ and you will probably find the Loveall's and all their UFCW Buddies involved in one way or another!!!!!

So President Lind at Local 5..... Do we have an extension agreement or not?????

Interesting that Local 5 pulls any reference to any Negotiation Updates for SaveMart / Lucky from their website page. (10-23-13 / 7:50am)

http://ufcw5.org/

Local 5's only reference is an outdated FoodMaxx Negotiations update for Foodmaxx Members June 23, 2011 Contract expiration.

Note: FoodMaxx parent company is SaveMart.

http://ufcw5.org/foodmaxx

Local 5 did post some information concerning the signing of an extension agreement with SaveMart / Lucky over on their Smartphone App dated October 22, 2013.

Agreement Extension Signed

Save Mart and Lucky Stores have signed a contract extension agreement covering all of their retail food stores in our jurisdiction. This means all of your current contract provisions will remain in effect as the Union and management continue negotiations for a new collective bargaining agreement.

Your wages, benefits and work rules will not change as we move past the original expiration date. The extension agreement has no expiration date, though either side, the unions or management, have the option of canceling it after giving 72 hours written notice.

Your Role

Your attention and participation in this process will be important to the success of the talks. Please continue to monitor the website and Local 5’s Facebook page for progress, meeting announcements and opportunities for involvement.

President Lind... thanks for the update. However, how about posting the Savemart / Lucky negotiation update information on on Local 5's website?

Thank You

Does it surprise anyone that Golden State is now getting into the Healthcare business. They have been owners of dental offices for years. http://dentalsourceofca.com/

It would be nice if the profits went back to the members instead of in Loveall's mattress.

Next they (Loveall) will own a communications company and bill for all work it/he sends to the Trust Fund. Oh he already does. http://bleicomm.com.

Ask the Trust Fund who they pay for their communication needs, printing, design and mailing. I bet you can find the Bleiweiss logo on the materials you recently received for open enrollment. Take a look, is it there?

It's time to cut the fat.

Negotiation Update for members at Lucky-SaveMart.

Posted November 14, 2013

Meeting Begins in Effort for a New Contract.

Representatives from UFCW Locals 5, 8 and 648 met with the company on Veteran’s Day, November 11th, at the Trust Fund in Walnut Creek.

The union’s representatives made it absolutely clear that they and the members are outraged by the fact that bonuses were paid to management while the rank and file is laboring under the stabilization agreement.

It was reiterated during the course of the meeting, by the union committee, that the stabilization agreement was to reinvest in the stores and get more customers through the doors to keep the company in business, not to line the pockets of store managers.

The committee let it be known, that as far as they were concerned, when the stabilization agreement expires in 2014 it’s toast.

Additionally, internal management personnel and operational issues are hampering progress in the talks.

The company has engaged the services of an individual well versed in union negotiations, who previously represented management at Shaw’s and Park and Shop, both UFCW shops on the East Coast.

It was divulged at the Veteran’s Day meeting that this person would be replaced at future meetings by a person yet to be determined by the company. These and other operational matters are slowing the process toward a new contract.

Local 5, 8 and 648 were successful in getting the company to agree to return to the table in early December regardless of their internal dysfunction.

Your Role

Your attention and participation in the process continues to be vital to the success of the talks. If you have an idea for inclusion in the negotiations forward to mhenneberry@ufcw5.org.

Please monitor the website and Local 5’s Facebook page for progress, meeting announcements and opportunities for involvement.
A couple of points....

Hey Local 5..... Please identify The Union's Representatives?????

Speaking of.....

Hey Local 5...... didn't Local 5 Union Representatives recently receive BONUSES as a result of finalizing their F.A.I.R. Contract?

And the difference would be what?????

Hey Local 5..... What if anything was said about reversing / eliminating the $5.00 per hour reduction in pay for "some" of our SaveMart / Lucky Member's?????

Hey Local 5..... with respect to the following "alleged" pledge, what in the hell does it mean?

Does the same position apply to Raleys / Nob Hill and their Stabilization Agreement?

Hey Local 5.... in an effort to provide full diclosure and complete transparency, please post the Union's and Employer Proposal's for Local 5 Member's to review.

Hey Local 5..... While you are negotiating with Savemart / Lucky, try and keep in mind that the owner is a BILLIONAIRE!!!

Ooo! What bad asses you are Loveall, Lind & Sharpe! You got Save-Mart to "agree" to come back to the table in December? And you call that a victory for the members???

Save-Mart will have banked all their holiday sales by then, leaving us members with no bargaining leverage! That's it Local 5, 8 and 648 threaten Save-Mart's greedy billionaire with a strike during the slowest and coldest time of year! Rolling Eyes What a bunch of useless fucktards you all are!

Here we go...

Northern Cal grocery negotiations UFCW style

The sad part is members will just sit back and allow themselves once again to be fist fucked by the sellouts running these local unions and their 2009 UFCW "Person of the Year" business partner & friend.

Come on UFCW have the guts to call these negotiations what they really are! Just another rank n file financial give away!

UFCW...

Next stop for Nor Cal UFCW members...

Hey Local 5 isn't this like calling the kettle black?

Rumor has it that Local 5 has some of it's own "internal dysfunction" going on as we speak. Some sources have told me that with Lind being forced out there's quite the feeding frenzy going within Local 5. It's even rumored that some of the reps in fear of losing their jobs have been secretly meeting with some members frantically digging for information.

Funny thing about these reps-when they feel their job is secure dues paying members issues is the last thing on their mind, but when there's a good possibility through the election process that a rep or two may lose their cushy job and a rank n file member with possible information now becomes that reps best friend.

I guess you could say that Local 5 these days is in an internal cold war? Will be entertaining to see how it all plays out and which reps end up in the unemployment line.

Regarding laboryes view point, I 100% agree with him. I smell another sellout. SaveMart workers are tired of exploitation and are willing to strike. If the UFCW is just prolonging things for a year and waiting for Raley's chain stores to get involved, they better think twice because those members have already been sold out courtesy of their "great and powerful" union and will not fall for it again. My advice would be for the UFCW to strike now while they still have some members willing to strike, and the holidays as the leverage for negotiating.

This Flyer was left in a lucky store lunchroom in a local 648 store outside of san francisco.

Dear Sisters and Brothers:

We are now in bargaining with Lucky's/Save Mart over working conditions, wages and benefits, along with the other Northern California UFCW Local Unions for a new Collective Bargaining Agreement.
While the Stabilization Agreement's temporary changes to your agreement continue in effect into August 2014, the more immediate negotiations will be over terms and conditions under the Collective Bargaining Agreement. Many of you have communicated with your Union Representatives your desire for changes in the contract during the last year, and these issues will be addressed with your employer negotiators. If you have additional thoughts regarding issues impacting you or your co-workers, please don't hesitate to communicate them to your Union Representative.
An initial negotiation session was conducted on November 11, 2013. and subsequent dates are in the process of being scheduled for the near futurs, subject to minor delays due to personnel changes.
As further developments and negotiations occur, we will continue to keep you informed. Should you have any questions, please don't hesitate to contact your Union Representative.

In Unity,

Micheal Sharpe Milton Hum
President Secretary-Treasurer

Word for word. I don't know when it was left, but it was given to me today.

Lind, Loveall and Sharpe...a.k.a. the Sellout Alliance continue to provide us with absolute meaningless Bull Shit "feel good statements" like the above!

After reading the above, it reminded me of the meaningless and Bull Shit Solidarity Alliance Pledge that Lind and Loveall created during the Raleys / Nob Hill debacle!

UFCW5 2012 Ratification Recommendation

Additionally, we can only hope that Lind, Loveall and Sharpe are monitoring our Food Pension Plan very closely and are prepared to do whatever it takes to protect our Plan, especially after reading the following article.

Lucky/Savemart was given the end of the year holidays. What a way to bargain a contract. Grocery workers are looking at the new normal.

Is it possible that Lind, Loveall and Sharpe have a Plan to Stall our Negotiations into 2014 so we can hook up with our UFCW Southern Californnia Local Union's for their upcoming Contract Negotiation's?

Quote:

Or.............

Will it once again be another squandered opportunity by our UFCW Union Leadership in Northern & Southern California to run and hide?

Hey Lind, Loveall and Sharpe, today is Tuesday December 10, 2013, what in the hell are you guys doing with respect to our Savemart / Lucky Negotiations?

Obviously with what I've been reading, Lind has been ordered by the DOL to run Local 5's third Union Election for a "cheating scandal", including announcing to his staff that HE will not run for re-election and will retire, Sharpe just got his "ass kicked" in his recent Union Election, it now appears that Loveall's "Solidarity / Sellout Alliance" is deteriorating right before Loveall's eyes!

Once again we see what happens to any UFCW Local Union Leader(s) who hook their wagon to the Loveall Regime, usually will have themselves (unemployed) and their respective memberships being Sold Out by the Sellout Alliance negotiating concessionary contracts on their behalf!

Speaking of Savemart / Lucky Negotiations here is Local 8's website update from November 15, 2013.

Save Mart Negotiations Update, November 15, 2013

TO ALL UFCW 8-GOLDEN STATE MEMBERS EMPLOYED BY
SAVE MART SUPERMARKETS/LUCKYS:

Dear Sisters and Brothers:

We are now engaged in bargaining with Save Mart/Luckys over working conditions, wage and benefits, along with the other Northern California UFCW Unions for a new Collective Bargaining Agreement.

While the Stabilization Agreement’s temporary changes to your Agreement continue in effect into August 2014, the more immediate negotiations will be over terms and conditions under the Collective Bargaining Agreement.

Many of you have been very clear in your desires for changes in the Contract in discussions with your District Union Representatives during the last year, and these issues will be addressed and thoroughly discussed with Save Mart’s negotiators. If you have additional thoughts regarding issues impacting you or your coworkers, please don’t hesitate to communicate them to your District Union Representative.

An initial negotiation session was conducted on November 11, 2013, and subsequent dates are in the process of being scheduled for the near future, subject to minor delays due to company personnel changes.

As further developments and negotiations occur, we will continue to keep you informed.

Should you have any questions, please don’t hesitate to contact your District Union Representative.

In Solidarity,

Jacques Loveall

UFCW Local 5 Negotiations Update for members at Lucky and SaveMart

Posted December 10, 2013

Unions and Lucky-Save Mart to Reconvene Talks December 12

Union and company negotiators are set to restart negotiations for a new contract on Thursday December 12.

The unions have used the time since the last meetings to put together a comprehensive list of contract demands which will be presented and explained to management.

Once management and union proposals have been formally exchanged they will be posted on the website in the same way they were during the last negotiations.

It is expected that management will have its bargaining team in place at the next meeting and will be prepared to engage in meaningful discussions to proceed toward a settlement.

Your Role

Your attention and participation in the process are vital to the success of the talks. If you have an idea for inclusion in the negotiations please forward it to mhenneberry@ufcw5.org.

Please monitor the website and Local 5’s Facebook page for progress, meeting announcements and opportunities for involvement.

www.ufcw5.org

As I see it, Lind having announced to his entire Staff that he will not run for re-election, clearly makes Lind a "LAME DUCK" in these upcoming negotiations!

No longer can Local 5's Staff, Executive Board, etc., BLAME and and or use the EXCUSE that Lind is responsible for negotiating a Concessionary Contract with Savemart / Lucky and or any other Employer!

It's quite simple!

Since Terry Gonzales and Esai Alday have already declared their candidacy for Local 5's President and Secretary Treasurer positions, then it is imperative that Gonzales, Alday, Local 5's entire Staff, including Local 5's Executive Board "order" Lind not to get involved in these upcoming negotiations with SaveMart / Luckys!

In fact, as I've said before, President Lind needs to retire now and leave Local 5 immediately!

Furthermore,.....

Quote:
The unions have used the time since the last meetings to put together a comprehensive list of contract demands which will be presented and explained to management.

It appears that the tone in Local 5's posting has changed from "putting together a comprehensive list of proposals...... to "putting together a comprehensive list of demands.

OK... I like that....

Now let's see if Local 5 can back up the tought talk?

Hey Local 5....

How about starting off with the following DEMAND from SaveMart / Luckys at tomorrow's meeting!

Give back the "permanent" $5.00 per hour reduction in pay you stole from "some' of our SaveMart / Lucky Member's!

Failure to do so will be a STRIKE ISSUE for Local 5!
